Please read this Terms and Conditions Agreement carefully before using the Farmfed Meat website.

By using farmfed.co.za, you confirm that you accept these Terms and Conditions Agreement and will comply with it. If you do not agree to this Terms and Conditions Agreement, you must not use farmfed.co.za in any way. This Terms and Conditions Agreement is written in English.

1. TERMS OF USE

1.1. These Terms and Conditions Agreement, together with all documents referred to in it, outline the terms for using our website, applications, platforms, services, and any interaction with farmfed.co.za, including but not limited to:

• www.farmfed.co.za
• Any Farmfed Meat related website(s) and/or channel(s)
• Via personal computer, mobile, web, wireless console, desktop, and any other technology or device
• Any other applications (including Google Android and Apple iOS apps)
• Via third-party sites or links (including social media sites)

(Collectively referred to as "our site").

1.2. This Terms and Conditions Agreement apply to all users of our site. A "user" is anyone who uses our site. Use includes:

• Accessing our site
• Browsing our site
• Registering to use farmfed.co.za

1.3. Please note that your use of our site via third-party media (including mobile/tablet apps and third-party sites/links) and any third-party services connected to our site (including YouTube, Facebook, X) may be subject to separate terms and conditions provided by the relevant third party(ies). You are responsible for reviewing these and using such media/services at your own risk.

1.4. In the event of a breach of these terms, the spirit of these terms, or any action we deem obscene, illegal, defamatory, derogatory, or harmful to our reputation, we reserve the right to take appropriate action, including:

• Disabling your account
• Removing content provided by you
• Implementing technical and/or legal measures to prevent your use of our site and/or interaction with farmfed.co.za in any way.

We may not offer a refund in such circumstances. This does not limit other remedies available to us.

2. OTHER APPLICABLE TERMS

The terms of all policies and agreements mentioned on our site are incorporated into these terms of use and apply to your use of our site and/or participation with farmfed.co.za in any way, including:

3.1. Our site is operated by Farmfed Meat (Pty) Ltd (referred to as "we" or "us"). We are registered in South Africa under company registration number: MPower Abattoirs (PTY) Ltd | Reg No: 2017/187104/07

3.2. Our site is made available for:

• Selling and promoting our quality farm-fresh meat products
• Offering cooking tips and recipes

3.3. Our site acts as a hosting service for any content, contribution, or information uploaded, posted, or otherwise provided.

4. CHANGES TO THESE TERMS

4.1. We may revise these terms of use at any time by amending these pages. Please check this page periodically for changes. Your continued use of our site and/or interaction with farmfed.co.za constitutes acceptance of these changes.

4.2. You are bound by the terms of use in place at the time of your use of any part of our site and/or interaction with farmfed.co.za.

5. CHANGES TO OUR SITE

5.1. We may update our site and change its content at any time. However, content may be outdated or inaccurate, and we are under no obligation to update it.

5.2. We may release new services, rules, features, tools, resources, or versions of our site (or parts thereof). These will be subject to these terms of use and any additional terms released for specific services or features.

6. ACCESSING OUR SITE

6.1. Access to our site is provided free of charge.

6.2. We do not guarantee uninterrupted availability of our site or its content. Access is temporary, and we may suspend, withdraw, discontinue, or change any part of our site without notice. We are not liable for any unavailability.

6.3. You are responsible for all arrangements and costs associated with accessing our site (including service provider charges and transaction fees).

6.4. You are also responsible for ensuring that anyone accessing our site through your internet connection is aware of and complies with these terms of use and any other applicable terms and conditions.

7. YOUR ACCOUNT AND PASSWORD

7.1. Browsing our site does not require registration. However, an account is required for purchases.

7.2. Registration requires providing certain information (including your real name and email address). You must ensure all information provided is and remains valid, accurate, and up to date.

7.3. Providing false personal information or creating an account for someone else without permission is prohibited.

7.4. If your account is disabled, you must not create another without our permission.

7.5. Your email address and other personal information will be treated according to our Privacy Policy.

7.6. Your username, password, and any security information must be kept confidential.

7.7. You are solely responsible for maintaining the confidentiality and security of your username and password and for all activity under your account.

7.8. If you suspect unauthorised access to your account, notify us promptly at orders@farmfed.co.za and change your password immediately.

7.9. We have the right to disable, suspend, cancel, remove, or reassign accounts, usernames, and passwords without prior notice in appropriate circumstances, including suspected violations of these terms or infringement of third-party rights or applicable laws.

7.10. You are solely responsible and liable for all uses of farmfed.co.za products or services under your username and for any User Content (as defined in paragraph 10), including any consequences of using or publishing such User Content.

7.11. For paid services, the owner of the user account and/or User Content is considered the person whose billing information was used for the purchase. However, we reserve the right to determine ownership at our sole discretion.

8. GENERAL

8.1. All purchases are subject to approval and validation upon successful checkout and payment via our secure payment gateway(s).

8.2. Products acknowledged upon pick-up are considered order completion, and returns for poor quality after pick-up will not be accepted.

8.3. The website, farmfed.co.za takes precautions to ensure product quality for pick-up. Customers are responsible for proper handling and storage after pick-up.

8.4. The website, farmfed.co.za reserves the right to reject claims for product mishandling or incorrect storage after the product has been picked up in good condition.

9. INTELLECTUAL PROPERTY RIGHTS

9.1. We are the owner or licensee of all intellectual property rights in our site and its content, including trademarks. We are the licensee of all user-uploaded content as per the licenses in paragraph 11.

9.2. All rights, title, and interest in farmfed.co.za services, including copyrightable materials, artwork, graphics, images, literary work, code, applications, designs, animations, interfaces, methods, products, algorithms, data, interactive features, advertising tools, inventions, trade secrets, logos, domains, URLs, trademarks, service marks, trade names, and other proprietary identifiers, whether registered or registrable, and their derivations, are owned by and/or licensed to us.

9.3. Subject to your compliance with these terms and payment of fees, we grant you a non-exclusive, non-transferable, non-sublicensable, revocable, limited license to use the farmfed.co.za services upon account creation and for as long as we provide the services.

9.4. You may print one copy and download extracts of webpages for personal use and share content posted on our site.

9.5. You must not modify printed or downloaded materials or use illustrations, photos, video, audio, or graphics separately from the accompanying text.

9.6. Our status (and that of any identified contributors) as authors of content on our site must always be acknowledged.

9.7. Unless explicitly stated in these terms, you must not use or authorise commercial use of any content on our site without obtaining a license from us, our licensors, or relevant third parties, including copyright holders of user-uploaded content.

9.8. If you breach these terms by printing, copying, or downloading any part of our site, your right to use our site will cease immediately, and you must return or destroy any copies at our discretion.

10. LINKING TO OUR SITE

10.1. If you create a personalised account with farmfed.co.za, you may link to any public-facing page of your account, provided the link is fair, legal, not obscene or defamatory, does not harm our reputation or other users, and does not suggest endorsement where none exists.

10.2. You must not establish a link implying any association, approval, or endorsement where none exists.

10.3. We reserve the right to withdraw linking permission without notice.

10.4. The website or channel providing the link must comply with the content standards in our Acceptable Use Policy.

11. FEES

Suppose any payment by you or a third party for your Farmfed Meat account is declined, charged back, or rejected. In that case, it constitutes a breach of your payment obligations, and your access to farmfed.co.za services may be disabled or terminated. We reserve the right to dispute any chargeback and to pursue all available rights and remedies, including informing authorities and/or initiating legal proceedings to recover outstanding sums.

12. E-COMMERCE ACTIVITIES

You are solely responsible for all e-commerce-related activities, promotions, and content within your User Content, and for complying with all applicable laws. We are not responsible for any transactions, your relationship with E-Commerce service providers, or their actions.

13. NO RELIANCE ON INFORMATION

13.1. Content and information on our site are for general information only and do not constitute advice. You should seek professional or specialist advice before acting or refraining from acting based on our site's content, including user-uploaded content.

13.2. We do not provide legal advice regarding laws applicable to the use of farmfed.co.za products or services.

13.3. While we may attempt to update site information, we make no guarantees about its accuracy, completeness, or timeliness.

14. LIMITATION OF OUR LIABILITY

14.1. Nothing in these terms excludes or limits our liability for death or personal injury resulting from our negligence, fraud, or any other liability that cannot be excluded or limited by South African law.

14.2. To the extent permitted by law, we exclude all conditions, warranties, representations, or other terms, whether express or implied, that may apply to our site, its content, or any interaction with farmfed.co.za.

14.3. We will not be liable to you, any user, or any third party for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising from or in connection with:

• Use of, or inability to use, our site
• Use of or reliance on any content (including User Content) displayed on our site
• Participation in and/or interaction with farmfed.co.za in any way
• Breach of these terms of use by users

14.4. You agree not to use our site for commercial or business purposes other than as intended by farmfed.co.za products, and we are not liable for any loss of profit, business, business interruption, business opportunity, or career enhancement or opportunity.

14.5. You acknowledge that our site is for facilitating, operating, and promoting Farmfed Meat and agree to use it accordingly.

14.6. We are not liable for any virus, distributed denial-of-service attack, trojan, worm, logic bomb, malicious software or code, bug, glitch, error, delay, inaccuracy, or other harmful material that may affect your technology, devices, applications, programs, data, User Content, or other material due to your use of our site, downloading content, or visiting linked websites or services.

14.7. We assume no responsibility for the content of linked websites or services and are not liable for any loss or damage from their use.

14.8. By using our site and/or interacting with farmfed.co.za, you irrevocably waive any claim against us, our subsidiaries, affiliates, successors, assigns, employees, agents, directors, officers, or shareholders regarding the foregoing.

14.9. Without limiting the above, we are not liable for any loss or damage arising from any "take down" initiated by or at the request/direction/cooperation of any Internet Service Provider (ISP).

14.10. Without limiting the above, we are not liable for any loss or damage arising from issues related to any Internet Service Provider (ISP) and/or any associated server.

14.11. Without limiting the above, you acknowledge that we may "roll back" to earlier versions of our site at any time and are not liable for any resulting loss or damage.

14.12. You agree to indemnify us for any claims, losses, expenses, damages, costs (including legal fees), and liabilities arising from your use of our site, interaction with farmfed.co.za, any breach of these terms, any unlawful or improper use of our site, or your violation of any law or third-party rights.

15. FARMFED MEAT'S REFUND POLICY

At Farmfed Meat, we pride ourselves on delivering the freshest, highest-quality meat directly to your door via five collection points in the North West province. Your satisfaction is paramount. Due to the perishable nature of our products, our refund policy is designed to ensure food safety and fair resolution for genuine concerns.

15.1. Eligibility for Refund or Replacement: You may be eligible for a refund or replacement if:

• The product delivered is incorrect (e.g., wrong cut or type of meat).
• The product is visibly damaged upon arrival or significantly spoiled.
• The product quality is demonstrably below our high standards (e.g., unexpected off-odour, unusual discolouration beyond normal variations).

15.2. Non-Eligibility for Refund or Replacement: We generally cannot offer refunds or replacements if:

• You have simply changed your mind after the order has been dispatched.
• The product has been partially or fully consumed.
• The product has been stored improperly after delivery (e.g., left unrefrigerated, refrozen after thawing).
• The concern is reported outside the specified timeframe (see point 3).
• Minor variations in appearance or weight that are within acceptable industry standards.
• Thawing of frozen product that is still cold to the touch and safe for immediate refrigeration/freezing upon delivery (this is normal during transit).

15.3. Reporting Issues (Timeframe is Critical): Due to the perishable nature of meat, all concerns regarding your order must be reported within 24 hours of delivery. Claims made after this period may not be eligible for review.

15.4. How to Initiate a Claim: To request a refund or replacement, please follow these steps:

• Contact us immediately within 24 hours of delivery via:

• Provide the following information:
  • Your Order Number.
  • A clear description of the issue.
  • Clear photographs or videos of the affected product, its packaging, and the delivery box, if applicable. This evidence is crucial for our assessment.

15.5 Assessment and Resolution: Upon receiving your claim and supporting evidence, our team will review the issue thoroughly. We may require further information or arrange for an inspection in certain cases.

• If your claim is approved, we will offer you a full refund to your original payment method, or a replacement of the affected product with your next order or via a separate delivery, at our discretion.
• You will be notified of our decision via email or phone within 2-3 business days of receiving your complete claim.

15.6. Collection Issues: If your order is damaged, is lost, or is significantly delayed due to issues on our end or with our delivery partners, please contact us immediately. We will investigate and arrange for a refund or re-collection as appropriate.

15.7 Policy Updates: Farmfed Meat reserves the right to modify this refund policy at any time. Any changes will be effective immediately upon posting on our website.
